Abstract

The paper includes three main sections. In the first one an overview ofhe right to education in international human rights law is presented. This part first explains the meaning and nature of the right to education in international human rights law, and then introduces the international legal origins of the right to education and the latest practical progress in international human rights law. The second section clarifies international legal obligations of states on the right to education. It proves that the content of the right to education is the obligation of the state to promote and protect the right to education. In section three the implementation of the right to education standard in international human rights law in China is presented. This section expounds China's theory and practice on the relationship between international law and domestic law, then summarizes the relevant legislation and practice, and finally expounds the current problems China encounters on the right to education and proposes corresponding solutions. The paper and points out that theoretical discussion on the right to education from the perspective of international human rights law has great practical significance
